Please read these Terms & Conditions (“Terms”, “Agreement”) carefully before using the website www.advaitacode.com and/or any services (including placement consultation, coding training, subscriptions, courses, modules) (collectively, the “Services”) provided by Advaitacode (“we”, “us”, “our”, “Advaitacode”). By accessing or using the Website and/or Services, you (“you”, “your”, “User”, “Member”, “Candidate”) agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Website or Services.
1. Interpretation & Definitions
1.1 “User Content” means any content posted, submitted or otherwise provided by a User (e.g., messages, uploaded files, forum posts, CVs, code submissions).
1.2 “Subscription” means access to certain parts of the Website or Services pursuant to a paid plan.
1.3 “Placement Services” means services where Advaitacode provides consultation, guidance, job-matching, placement assistance to Candidates.
1.4 “Training Services” means coding courses, tutorials, materials provided by Advaitacode.
1.5 “Effective Date” means the date you first accepted these Terms or began using the Services.
2. Eligibility
2.1 You represent and warrant that you are of legal age to enter into a binding agreement under applicable law (in India, 18 years or older), or you are accessing and using the Website/Services under the supervision and consent of a parent or legal guardian who accepts these Terms on your behalf.
2.2 If you are under the age of 18 years, your parent or legal guardian must read and agree to these Terms and the Privacy Policy prior to your use of the Website or Services. We consider all activities conducted under your account as having been authorized by your parent or guardian.
2.3 We reserve the right to request proof of age or parental consent at any time, and to suspend or terminate access if such proof is not provided or is found to be false.
2.4 If we become aware that we have collected personal or registration information from a minor without appropriate consent, we will take steps to delete such information promptly in accordance with our Privacy Policy.
2.5 We may, at our sole discretion, restrict certain Services, communications, or features for users under the age of 18 to ensure compliance with applicable laws and safeguard minors' online safety.
3. Account Registration & Access
3.1 To use certain Services (e.g., access courses/quizzes/tests, download materials, placement dashboards) you may be required to register for an account, providing accurate, complete and up-to-date information.
3.2 You are responsible for safeguarding your password, account credentials, and for all activity under your account. You must notify us immediately of any unauthorized use or breach of security.
3.3 We reserve the right to suspend or terminate your account if you believe your account or credentials have been compromised.
4. Service Description & Payments
4.1 We endeavour to describe our Services (Course Material, Quizzes, Tests, Training Services, Placement Services, Subscriptions) on the Website, but we do not guarantee completeness, accuracy or timeliness of descriptions, pricing or availability.
4.2 Payment Terms: If you purchase or subscribe to any paid plan, you agree to pay all fees as described at the time of purchase. All fees are non-refundable unless otherwise explicitly specified.
4.3 Taxes: You are responsible for all applicable taxes, duties, levies in your jurisdiction (GST in India) relating to your purchase.
4.4 Refund/Cancellation: Unless otherwise specified in your plan/documentation, we reserve the right to refuse refunds. If you cancel before the end of a subscription period, the unused portion may not be refunded (unless stated).
4.5 Free Trials: If offered, are subject to separate terms; if you do not cancel before the end of the trial, the paid subscription may commence.
4.6 Change of Pricing:
We reserve the right to modify the pricing of any course, module, plan, or subscription at any time without prior notice.- Any such change will not affect users who have already purchased or subscribed to a course before the price change, for the duration of their current subscription or course access period.
- For recurring subscriptions, any revised pricing will apply from the next billing cycle, and users will be notified in advance via email or on the Website.
- We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of any Service.
5. Placement Services Specifics
5.1 While we provide guidance, consultation and assist you in preparing for job placements, we do not guarantee job offers or placement within any timeframe.
5.2 You agree to provide accurate personal information, send your CV / portfolio when asked, attend interviews, meet clients and cooperate in good faith.
5.3 You will not directly contact a client, employer or recruiter introduced by Advaitacode without our prior written consent during the placement process. If you do, you may forfeit your rights under our placement assistance programme.
5.4 In the event of placement via our service, you may be required to pay a placement fee or commission (if applicable) as described in your plan or agreement.
5.5 Third-Party Employers: While we connect candidates with potential employers, all employment offers, compensation, and onboarding terms are entirely between the employer and candidate. Advaitacode bears no liability for any employment disputes or losses once placement occurs.
6. Training Services Specifics
6.1 Access to course materials, live sessions, workshops: You are granted a non-exclusive, non-transferable, limited licence to view/use the materials for your personal, non-commercial use only.
6.2 You must not reproduce, distribute, modify, publicly display or exploit the learning materials for commercial purposes unless we give express written permission.
6.3 We may update, modify, suspend or discontinue courses or parts thereof at any time. We will endeavour to notify you of major changes, but we are not obliged to do so.
6.4 Certificates/Badges: Any certificate, badge or accreditation is subject to verification, and we reserve the right to revoke it in case of misconduct, misconduct or breach of Terms.
7. Intellectual Property Rights
7.1 Except for your User Content, all intellectual property rights in the Website, Services, course materials, designs, text, graphics, logos, software are owned by or licensed to Advaitacode. All rights reserved.
7.2 You may not use, copy, reproduce, republish, upload, post, transmit or distribute any part of the Website or Services without our prior written consent.
7.3 If you submit any User Content you grant us a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, modify, adapt, publish, translate, distribute, display and create derivative works from your User Content for the purpose of operating, promoting or improving the Services.
7.4 If you believe your copyright or trademark rights are being infringed on our Website you must send us a written notice identifying the infringing material, your rights and request removal.
7.5 DMCA/Notice-and-Takedown: If you believe any material hosted on the Website infringes your copyright or other intellectual-property rights, please notify our Grievance Officer (see Section 20) in writing with: (a) identification of the infringing material, (b) proof of ownership, and (c) your contact details. We will acknowledge within 24 hours and take appropriate action within 36 hours as per Indian law.
8 User Conduct / Acceptable Use
8.1 You must use the Website and Services in accordance with all applicable laws and regulations in your jurisdiction.
8.2 You agree not to:
- use the Services for illegal or fraudulent purposes;
- impersonate any person or entity, or falsely state or misrepresent your affiliation;
- upload or transmit viruses, malware or harmful code;
- interfere with or disrupt the Website, servers or networks;
- attempt to gain unauthorised access to any part of the Website or Services;
- use automated systems to scrape, harvest or collect data from the Website;
- engage in harassment, defamation, hate speech, or other unlawful content;
- infringe any intellectual property or privacy rights of others;
- interfere with the recruitment or placement process of another user;
- circumvent any security or access restrictions;
- use the Website or Services for any other purpose not expressly permitted herein.
- host, display, upload, modify, publish, transmit or share any information that is unlawful, defamatory, obscene, invasive of privacy, racially or ethnically objectionable, or otherwise prohibited under the Information Technology Act 2000 and the Intermediary Guidelines Rules 2021.
9. Suspension & Termination
9.1 We may suspend or terminate your access (in whole or part) immediately and without notice if you breach these Terms, or we reasonably suspect you are engaging in prohibited conduct.
9.2 On termination, your right to access the Services will cease, and we may delete or disable your account, remove content and restrict future access.
9.3 Sections that survive termination: Intellectual Property Rights (Section 7), User Content licence (7.3), Disclaimer of Warranties (12), Limitation of Liability (13), Governing Law (15) and any other provision which by its nature should survive.
10. Third-Party Links & Services
10.1 The Website may contain links to third-party websites, services or advertisements. These links are provided for convenience only. We do not control and are not responsible for the content, accuracy or availability of third-party websites or services.
10.2 Your interaction with any third-party site is solely between you and the third party; we disclaim any liability arising from such interaction.
10.3 For certain services (e.g., placement with an employer), you may enter into a separate agreement with a third party. We are not party to that agreement and disclaim any responsibility for obligations or liabilities arising under those agreements.
10.4 External Tools and Integrations: The Website may use third-party API integrations (e.g., Zoom, Google Meet, payment gateways) to deliver Services. You consent to such integrations and acknowledge that their use is governed by the respective third party's terms and privacy policy.
11. Disclaimers & Warranties
11.1 The Website and Services are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability.
11.2 We do not guarantee that the Website or Services will be uninterrupted, error-free or immune to viruses or other harmful components.
11.3 We do not guarantee any specific results from the use of the Services (for example, job placement, profit, or success).
11.4 We do not warrant that any course content or advice will meet individual expectations. You acknowledge that outcomes depend on your own effort and circumstances.
12. Limitation of Liability
12.1 To the maximum extent permitted by applicable law, in no event will Advaitacode, its officers, directors, employees, agents, affiliates or licensors be liable for any indirect, incidental, special, consequential or exemplary damages (including loss of profits, loss of data, business interruption) arising from your use or inability to use the Website or Services.
12.2 Our aggregate liability for all claims arising out of or relating to these Terms or the Services shall not exceed the lower of (INR ₹1,00,000) or the amount you paid to Advaitacode in the 12 months immediately preceding the claim.
12.3 Some jurisdictions do not allow limitation of implied warranties or certain liabilities, so some of this section may not apply to you.
13. Indemnification
You agree to defend, indemnify and hold harmless Advaitacode, its officers, directors, employees, agents and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs or debt (including legal fees) arising from:- your violation of these Terms;
- your use of the Website or Services;
- your User Content;
- your violation of any law or the rights of a third party.
14. Modification of Terms / Changes to the Service
14.1 We reserve the right to modify or replace these Terms at any time by posting the updated Terms on the Website and updating the “Last updated” date. You are responsible for checking these Terms periodically.
14.2 If a revision is material, we will provide at least 30 days' notice prior to new terms taking effect. What constitutes “material” is at our discretion.
14.3 By continuing to access or use the Website or Services after those revisions become effective, you agree to be bound by the revised terms.
14.4 We reserve the right to modify, suspend or discontinue the Website or Services (or any portion thereof) at any time, with or without notice and without liability to you.
15. Governing Law & Dispute Resolution
15.1 These Terms and any dispute arising out of or related to the Website or Services will be governed by the laws of India. The courts of [Gurugram, Haryana] shall have exclusive jurisdiction to resolve any dispute.
15.2 You agree that any claim or cause of action you may have arising out of or related to the Website or Services must be filed within one (1) year after such claim or cause of action arose, otherwise it is permanently barred.
15.3 Before initiating legal action, the parties shall first attempt good-faith resolution via email or virtual meeting within 15 days of notice. If unresolved, courts of Gurugram, Haryana shall have exclusive jurisdiction.
16. Severability
If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.17. Waiver
No waiver of any term or condition in this Agreement shall be deemed a further or continuing waiver of such term or any other term. Failure of either party to enforce any right will not be deemed a waiver of future enforcement of that right or any other right.18. Entire Agreement
These Terms constitute the entire agreement between you and Advaitacode regarding your use of the Website and Services and supersede all prior or contemporaneous agreements, proposals, negotiations and communications.19. Compliance with Information Technology Act 2000 and Safe Harbour
19.1 Advaitacode is an “intermediary” under Section 2(w) of the Information Technology Act, 2000 and complies with the Intermediary Guidelines Rules 2021.
19.2 We are not liable for third-party information hosted or made available on our Website so long as we observe due diligence and remove unlawful content upon notice.
19.3 Users shall ensure their submissions do not violate the Act or any other law for the time being in force.

20.1. Grievance Officer and Notice-Takedown Mechanism
(a) In accordance with Rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Advaitacode has appointed the following Grievance Officer:

(b) The Grievance Officer will acknowledge complaints within 24 hours and resolve them within 15 days of receipt.
(c) Upon receiving actual knowledge of any unlawful content or a valid court/government order, we shall remove or disable access to such content within 36 hours and retain records for 180 days or as legally required.
